Sentencing for a man who failed to secure heavy machinery weighing 7.6 tonnes on his trailer, causing it to tip and another driver to crash into it, has been deferred.

At the sentencing hearing for Alan John Chappell on Monday, October 13, Gavin Paterson and his wife, Lynda, read victim impact statements to Albury court.

After hearing the statements, magistrate Sally McLaughlin adjourned the matter to Monday, October 20.

Mr Paterson was almost killed in the June 24 crash on the Riverina Highway at Splitters Creek last year.

He crashed into a telehandler towed by Chappell that had tipped moments earlier, and suffered life-changing injuries.

Chappell, who contested the charges claimed that legally, he wasn't driving, as the truck "took control", having told police during an interview the steering wheel and brakes locked.

Ms McLaughlin, on Friday, August 15, rejected that explanation and found the truck locked up when the trailer and telehandler tipped.

In his statement read to the court on Monday, Mr Paterson said before the incident he was able to run multiple jobs and sites dealing with builders.

"Now just trying to think through and complete one item takes its toll on my physical as well as mental energy levels that lead to me being frustrated and lashing out verbally at the ones who love me," Mr Paterson said.

"My brain injury makes concentrating, interacting, remembering things as well as word finding that much more difficult.

"I have a wife, Lynda, and we have five kids ... they have been through all sorts of traumas ... the not knowing if I was going to live or die.

"I now have permanent physical limitations which have had a huge impact on my previously very fit and active lifestyle."

Mr Paterson's wife, Lynda, then read out her statement, opening by saying she "had a gamut of emotions running ... anger, sadness, fear, abandonment, despair, frustration, bitterness, loneliness and on top of that I desperately grasp on to hope".

"We had plans for building our new home," she told the court. "Gav would never be able to do the bulk of the labour ... that has been scrapped.

"During the 18 weeks of Gavin's hospitalisation, I was in touch with a counsellor every day. I was using therapy to release and explain my emotions.

"All this is so sad as it didn't need to have happened.

"The blessing is, yes, he is alive, and he is still very loved by me and his family and friends.

"Our later years have had to take on a new plan for what our future looks like.

"Not quite the years of adventure and travel ... the joys of sharing growing older together.

"That was taken away from us."

The defence said Chappell had already been punished through his business being hurt and the effect the ordeal had had on his family.

Chappell had been charged with offences including dangerous driving occasioning grievous bodily harm, negligent driving occasioning grievous bodily harm, and towing a vehicle when unsafe, driving a vehicle with an unsecured load, using a heavy vehicle with defective brakes and using a heavy vehicle not in a registered configuration.

The sentencing hearing will resume at Albury court on Monday, October 20.
