The government shutdown, now having stretched into its 18th day, is set to close the Supreme Court to the public today and leave members of the Capitol Police unpaid.

The nation's highest court will continue to carry out critical business, but the Supreme Court's building will close to the public 'until further notice,' according to a spokesperson.

Visitors will not be able to tour the building and its exhibits until funding is restored.

'The Supreme Court will continue to conduct essential work such as hearing oral arguments, issuing orders and opinions, processing case filings, and providing police and building support needed for those operations,' Patricia McCabe, the court's public information officer, told CBS News.

The funding lapse is not just affecting the Supreme Court. The entire federal judiciary will run out of money on Monday 'to sustain full, paid operations.'

Federal judges will continue to serve and be paid, but some staff will go without paychecks if they are working on critically important cases. Those who are not working on such cases will be furloughed without pay.

'Each appellate, district, and bankruptcy court will make operational decisions regarding how its cases and probation and pretrial supervision will be conducted during the funding lapse. Each court and federal defender's office will determine the staffing resources necessary to support such work, according to a press release from the United States Courts.

Across the street from the Supreme Court is the Capitol Building, and the officers protecting the lawmakers who have failed to reach a deal on the shutdown missed their first full paycheck on October 10.

'They're asked to be everything to everybody,' Terry Gainer, a former Capitol Police chief, told NPR. 'You need to be ready at the drop of a hat to take very aggressive enforcement action, but you also have to be a person who will welcome visitors and be a tour guide.'

Officer Gus Papathanasiou, the Capitol Police union chair, raged at lawmakers last week for not being able to end the crisis.

'The longer the shutdown drags on, the harder it becomes for my officers. Banks and landlords do not give my officers a pass,' he wrote in an October 14 statement.

The Senate failed for the 10th time on Thursday to pass a GOP bill that would fund the government and end the shutdown.

The vote tally was 51-45, meaning Republicans were nine votes short of reaching the 60-vote filibuster threshold. They gained no new Democratic support, indicating that both sides remain dug in.

Another bill that would have funded the Pentagon for the next year also failed to reach 60 votes on Thursday.

House Speaker Mike Johnson has maintained that his chamber passed a nonpartisan, 'clean' funding bill on September 19 and has refused to call the House back into session until the Senate ends the shutdown.

He has also called on his members to stay in their home districts to put pressure on House Minority Leader Hakeem Jeffries and Senate Minority Leader Chuck Schumer, both New York Democrats.

The shutdown began on October 1 and came because Democrats felt that the temporary funding measure should have had a permanent extension to the tax credits for Americans who buy health insurance through the Affordable Care Act marketplace, also known as Obamacare.

Referred to as enhanced premium tax credits, they were introduced in 2021 and later extended through the end of 2025 by the Inflation Reduction Act.

They have significantly brought down the cost of health insurance for approximately 22 million low- and middle-income Americans. Additionally, the number of enrollees in ACA marketplace health plans has nearly doubled, according to healthcare outlet KFF.

So far, the vast majority of Republicans have refused to negotiate on this until the government is reopened.

Representative Mike Lawler, a Republican from New York, confronted Jeffries in the halls of Congress on October 8 for not supporting a GOP-introduced bill that would extend the ACA subsidies through 2026.

The next day, Jeffries went on CNN and pointed out that the proposal 'doesn't even have the support of the House Republican leadership, who have refused to address the issue of extending the Affordable Care Act tax credits.'

'It's a laughable proposition. It makes no sense,' Jeffries also told reporters on Capitol Hill. 'The Democratic position has been clear: Permanent extension, and let's go from there.'

The pressure is on because open enrollment to get coverage next year under Obamacare begins on November 1 and ends on December 15.

The last deadline to get coverage is January 15, 2026. If enrollees sign up before that date, their plan will become effective on February 1, 2026.
